Terms of use
The terms you accept when you create an account in the CBAM Wise portal. The same text as in the portal; Danish translation on cbamwise.dk.
Version 2026-10-21b
These terms apply between SaiNova Solution (CVR 45565092, Esbjerg, Denmark; "we") and the business that uses CBAM Wise ("you"). By creating an account, or by accepting them in CBAM Wise, you accept them on behalf of your business.
1. The service
1.1 CBAM Wise is software, provided as a service over the internet, that helps importers and their customs representatives with the EU Carbon Border Adjustment Mechanism (CBAM): it reads customs data, works out which goods are covered and the yearly 50 tonne threshold, collects emissions data from suppliers, and estimates embedded emissions, certificates and costs.
1.2 We may develop and change the service. We tell you in good time before we remove a function you use.
2. Business use and accounts
2.1 CBAM Wise is for businesses only, not for consumers.
2.2 Each user has a personal login and keeps it secret. Owners and filers use two-factor login. The owners of a workspace decide who has access and with which role.
2.3 You are responsible for what happens under your users' logins, and you tell us at once if you suspect misuse.
3. Fees
3.1 The price and content of each plan are those shown when you choose it, or in your order. Prices are in euro and exclude VAT.
3.2 During the pilot, use is free of charge unless agreed otherwise in writing.
3.3 We tell you at least 60 days before a price increase for your plan. You may then end the contract from the date of the change.
4. Your responsibility for your CBAM declaration and your data
4.1 You, or the outside filer you authorise, are responsible for: (a) the accuracy and completeness of the data you, your suppliers or your filer put into CBAM Wise; (b) checking the results before relying on them, including every line marked "not decided yet"; and (c) your CBAM declaration, your applications to the CBAM Registry and the purchase and surrender of CBAM certificates.
4.2 CBAM Wise does not submit anything to an authority on your behalf. Its results are calculations and information, not legal or tax advice. Estimates are labelled as estimates.
4.3 Decisions you or your filer make in CBAM Wise are recorded with who made them and when.
5. Your data and privacy
5.1 Your data is yours. We use it only to provide CBAM Wise to you.
5.2 For the personal data in your workspace you are the controller and we are your processor. The data processing agreement (at /dpa: the Danish Data Protection Agency's standard contractual clauses, filled in for CBAM Wise) is part of these terms.
5.3 For our users' account data we are the controller; our privacy notice (at /privacy) explains how we use it.
5.4 Customer data, backups and logs are stored in the EU. The sub-processors we use are listed in the data processing agreement.
6. Suppliers
6.1 Suppliers answer your requests through a secure link. What a supplier sends you is used for your workspace, and shared with another customer only with the supplier's consent, recorded in CBAM Wise.
6.2 You make sure you may contact the supplier contacts you add.
7. Availability and support
7.1 We aim to keep CBAM Wise available at all times but do not promise uninterrupted service. We announce planned maintenance in advance where possible.
7.2 Support is given by email at [email protected] on Danish working days.
8. Limitation of liability
8.1 Our total liability towards you is limited to the fees you paid us for CBAM Wise in the 12 months before the event that caused the loss.
8.2 We are not liable for indirect or consequential loss, such as lost profit, lost turnover, loss of goodwill or loss of data you could have exported, nor for fines, penalties or surcharges imposed on you, including under the CBAM rules, which follow from your own declaration (clause 4).
8.3 These limits do not apply to loss we cause intentionally or by gross negligence.
9. Term and termination
9.1 The contract runs until you or we end it. You may end it at any time with effect from the end of the current billing period; during the pilot, at any time.
9.2 We may end it with 30 days' notice, or at once if you seriously breach these terms.
9.3 Before the end you can export all of your company's data (Settings > Company > Export). After the end we delete the workspace as described in the data processing agreement.
10. Changes to these terms
10.1 We may change these terms. A new version is shown at each user's next login and applies once accepted. If you do not accept it, you may end the contract and export your data.
10.2 Each acceptance is recorded per user with the version and the date. This is version 2026-10-21b.
11. Governing law and venue
11.1 Danish law applies.
11.2 Disputes are settled by the Danish courts, with the court in Esbjerg (Retten i Esbjerg) as the first instance.
